THC Drinks in Pennsylvania: Are They Legal, Where to Buy Them, and What's Changing (2026)

Three hemp THC drinks that ship to Pennsylvania: Cann Blood Orange Cardamom, Cycling Frog Ruby Grapefruit and Mary Jones Root Beer Zero

Pennsylvania has no law written for hemp-derived THC drinks: no milligram cap, no seller license and no minimum age in statute, and they can be shipped to your door. Bars and other liquor licensees may not sell them. A pending Senate bill, SB 49, would follow the federal 0.4mg limit. Here are the rules and where to buy.

Pennsylvania regulates hemp as a farm crop. Growers and processors need a Department of Agriculture permit, but no state statute sets rules for selling finished hemp THC drinks. The Department says there is "not a state level permit/license requirement" for retailing hemp products (PDA hemp FAQ). It also says the FDA has approved only three hemp-seed ingredients for food, so its own position is that other hemp-derived ingredients are not approved food ingredients.

The Liquor Control Board takes a firmer line: it will not approve the sale of any product containing THC on a liquor-licensed premises. In the Senate, SB 49 would create a Cannabis Control Board and adopt the federal 0.4mg limit. It failed a floor vote in June 2026 but remains alive. This guide covers the law, where to buy, how to choose a strength, and the federal change on December 11, 2026. Every legal claim links to its primary source.

Key Takeaways

  • No state law written for hemp drinks. Hemp is regulated as a controlled plant under 3 Pa.C.S. §1501 et seq., with a Department of Agriculture permit for growers and processors.
  • No milligram cap in state law.
  • No minimum age in statute. HempBeverages.com sells only to adults 21 and over.
  • No retail license. The Department of Agriculture says no state permit is required to retail hemp products.
  • Not in bars. The Liquor Control Board will not approve THC products on liquor-licensed premises (Advisory Notice 28).
  • SB 49 is pending. It would adopt the federal 0.4mg-per-container limit. It failed 23-27 on June 10, 2026, was reconsidered, and is still before the Senate.
  • Federal change on December 11, 2026. 0.4mg total THC per container becomes the federal hemp limit.

Hemp THC drinks are widely sold in Pennsylvania, and no state statute in force today regulates how they are sold. That makes Pennsylvania an unregulated market rather than a licensed one.

How Pennsylvania Regulates Hemp

Pennsylvania treats hemp as a controlled plant under 3 Pa.C.S. §1501 et seq. Growers and processors need a Department of Agriculture permit. For finished products, the Department says there is no state permit or license for "wholesaling, retailing or brokering hemp and hemp products," and businesses that make hemp food products must register as food establishments (PDA hemp FAQ). The same FAQ notes that the FDA has approved only three hemp-seed ingredients for food and "no other cannabis or cannabis-derived ingredients."

What Pennsylvania Does Not Regulate (Yet)

We found no Pennsylvania statute that:

  • sets a minimum age for buying hemp THC drinks
  • caps milligrams per serving or per container
  • requires a retail license for hemp products
  • bans shipping hemp drinks to a home

Bars and Liquor Licensees

The Pennsylvania Liquor Control Board's Advisory Notice 28 (revised April 1, 2026) says the Board "will not approve the sale of… products containing any amount of tetrahydrocannabinol (THC)" by its licensees. Bars, restaurants and beer distributors with a liquor license may not sell THC drinks.

SB 49: the Bill to Watch

SB 49, sponsored by Sen. Dan Laughlin, would create a Pennsylvania Cannabis Control Board. In March 2026 the Senate Law and Justice Committee amended it, 10-1, to treat hemp products over 0.4mg total THC per container as non-hemp, switch to a total-THC test, and ban synthetic cannabinoids (Cannabis Business Times). It failed final passage 23-27 on June 10, 2026. The Senate then voted 29-21 to reconsider, which keeps it alive. On September 28, 2026 it was laid on the table and removed from the table again. As of this update it has not passed the Senate.

Pennsylvania doesn't cap the dose, so the full range of strengths is available. That's useful if you know what you want and easy to get wrong if you don't. The number on the can is the THC in the whole container unless the label says otherwise. Drink half a 10mg can and you've had 5mg.

Onset and Duration

THC drinks usually take effect in about 15 to 20 minutes, though it varies with your body, what you've eaten, and the drink. Effects typically last a few hours. Wait a full hour before opening a second one. Most bad experiences come from stacking cans before the first has fully kicked in. What's Changing? The Future of THC Drinks in Pennsylvania

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. Read our full explainer: what December 11 means for THC drinks.

Industry Response

Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed. December 11 is also the date the stopgap funding expires, so the next federal funding bill is the one to watch.

What It Means for Pennsylvania Buyers

  • Today: no Pennsylvania law limits hemp THC drinks, and we ship them to adults 21+.
  • If SB 49 passes: Pennsylvania would adopt the federal 0.4mg-per-container limit and a Cannabis Control Board.
  • After December 11: unless Congress acts, hemp THC drinks over 0.4mg per container lose federal hemp status in every state. If you have favorites, stock up while the full lineup is here, and check how to store THC drinks so they keep.

THC Seltzers vs. Traditional Edibles: Key Differences

Hemp gummies are easier to find than drinks in many Pennsylvania shops. Many people who try both choose drinks for a few practical reasons.

Factor THC drinks Gummies and edibles
Typical onset About 15–20 minutes, though it varies Often 30 minutes to 2 hours
Dose control Easy to sip part of a can and stop Sold as fixed pieces; you cut them to adjust
Social fit Replaces the drink in your hand at a party or cookout Nothing to hold or sip
Calories Many seltzers run low; see our low-calorie picks Usually sugar-based

Absorption and Practical Considerations

Drinks often take effect sooner because they reach your stomach as a liquid, and many brands use water-soluble emulsions. Edibles have to be digested first. The faster onset has a downside: a second can tastes just like the first, so it's easy to drink one before the first has peaked. Pace yourself the way you would with cocktails. Read the full comparison: THC drinks vs. edibles.

THC Spirits and Mocktails: A Growing Category

Not every THC drink comes in a can. Zero-proof THC spirits are designed to replace the vodka, gin or tequila in a recipe you already make. You keep the drink and leave out the alcohol.

  • Twofold makes six low-dose spirits, from vodka to spiced rum.
  • Pamos sells its Signature (5mg) and Reserve (10mg) spirits in 750mL bottles and 50mL minis.
  • Reframe and the FLORA 10mg Spirit are made for mixing.

Driving After a THC Drink

Pennsylvania's DUI law includes a per se offense for driving with any amount of a Schedule I controlled substance or its metabolite in your blood (75 Pa.C.S. §3802(d)(1)), as well as an impairment offense. A blood test measures THC and its metabolite, not where the THC came from. If you've had a THC drink, don't drive.

How to Check a Can Before You Drink It

Pennsylvania does not set its own labeling rules for hemp drinks, so checking a can is on you. Before you open one from any seller:

  1. Find the QR code and scan it. It should open the certificate of analysis for that batch.
  2. Match the batch number on the can to the batch number on the COA.
  3. Compare the potency. The THC result on the COA should be close to the milligrams printed on the label.
  4. Check the expiration date, especially for cans that have sat on a warm shelf.

Industry testing has found that many THC drinks don't match their labels. Read how to read a COA for what to look for.

Why Trust This Guide

HempBeverages.com is an online retailer that ships THC drinks to Pennsylvania, so we have a commercial interest in this topic. We address that by sourcing every legal claim. The statements in this guide link to Pennsylvania Department of Agriculture and Liquor Control Board guidance, Senate bill records and the federal public laws. We re-check them on the date shown at the top of the page. Our standards are on the editorial standards page. To compare Pennsylvania with other states, see where THC drinks are legal by state.

Final Verdict

Pennsylvania is open to hemp THC drinks today, mostly because it hasn't regulated them:

  • There is no state milligram cap, retail license or statutory age, though we sell only to adults 21+.
  • Bars and other liquor licensees can't sell them.
  • SB 49 would adopt the federal 0.4mg limit if it passes.

The federal change on December 11, 2026 applies here too unless Congress acts. Until then, choose a strength that suits you, start lower than you think you need, and wait a full hour before a second drink.
