Hemp-derived THC drinks are not legal everywhere, and the rules move month to month. Here is where all fifty states and the District of Columbia stand, each with the statute or rule it comes from.

Qué significan las etiquetas

  • Legal — Generalmente legal y más fácil de comprar, aunque algunas marcas aún no envían todos los productos.
  • Legal con restricciones — Legal de alguna forma, con reglas adicionales como límites de THC, pruebas de laboratorio, etiquetado o restricciones sobre dónde se puede vender.

One date that changes all fifty

A federal rule taking effect 11 December 2026 redefines hemp and caps finished products at 0.4mg of total THC per container — below almost every hemp drink on the market. That date was originally 12 November. A short-term government funding bill passed the House 370–48 on 1 September 2026 and was signed days later, moving it back by one month. Every state writes its own rules — potency caps, minimum ages, who is licensed to sell, and whether anything may be shipped at all. Each entry below cites the governing statute or rule so you can check it yourself.

    Legal only in person from a retailer licensed by the state ABC Board. Online, mail-order and delivery to consumers are prohibited.
