Where Are THC Drinks Legal? State-by-State (2026)

Hemp-derived THC drinks aren’t legal everywhere — and “available online” doesn’t mean “shippable to you.” Use the snapshot below to see how each U.S. state treats hemp THC products. On our store, the simplest check is always checkout: restricted states are blocked automatically, so if your order goes through, we can ship to you.

Snapshot based on VICE’s state-by-state guide, last updated June 23, 2026. Laws change fast — this is general information, not legal advice.

What the labels mean

  • Legal — Generally legal and easier to buy, though some brands still may not ship every product.
  • Legal With Restrictions — Legal in some form, with extra rules such as THC caps, lab testing, labeling, or limits on where it can be sold.
  • Heavily Restricted — Some products may be legal, but major parts of the market are blocked (delta-8, THCA flower, vapes, high-dose edibles, and more).
  • Illegal — Intoxicating hemp products are banned or treated like cannabis. Don’t assume gummies, drinks, vapes, or flower can ship there.
  • Unclear / Changing — Rules are messy, changing quickly, or enforced inconsistently. Check before buying.

Heads up — November 12, 2026. A new federal rule based on total THC is expected to take effect, which could pull many hemp THC products from the market and redraw this map. Read what’s changing → and consider stocking up while the full lineup is still here.
