In November 2025, a federal spending law (the FY2026 agriculture appropriations act, P.L. 119-37) redefined hemp using total THC rather than just Delta-9, and excluded finished consumable products containing more than 0.4mg of THC per container. That removes the legal footing for most hemp-derived THC beverages as they exist today. The law included a one-year transition period, so enforcement begins November 12, 2026.
