Understanding Florida's Hemp Law

The governing law is Section 581.217 of the Florida Statutes, the State Hemp Program. Its current form dates to SB 1676, signed in 2023 and in effect since July 1, 2023. That bill added the age-21 rule and the packaging standards that apply today.

The law defines “hemp extract” as an ingestible substance derived from hemp with no more than 0.3% total delta-9 THC on a wet-weight basis. “Total” means THC plus THCA, the form that converts to THC when heated. The statute also says compliant hemp-derived cannabinoids are not controlled substances in Florida.

The 0.3% limit is measured by weight, so a drink is mostly water and the ceiling is high. A 12oz can weighs about 355 grams, and 0.3% of that is roughly 1,000mg of THC. The strongest drinks we carry hold 50mg. In practice, the state limit sets no dose ceiling on a drink.

What Florida Requires of Every Product

To be sold in Florida, a hemp extract product has to meet three sets of requirements in 581.217(7).

Testing. The product needs a certificate of analysis (COA) from an independent, ISO 17025-accredited lab. The COA has to confirm the batch is under the 0.3% limit and free of unsafe contaminants.

Labeling. The container needs all of the following:

  • A scannable barcode or QR code linked to that batch's COA
  • The batch number
  • A website for batch information
  • An expiration date
  • Milligrams of each marketed cannabinoid per serving

Packaging. The container has to limit light and heat exposure and comply with the federal Poison Prevention Packaging Act. It also cannot be “attractive to children.” Florida defines that more broadly than most states: no shapes of humans, cartoons or animals, no resemblance to a familiar branded candy, and no color additives. Products that are mislabeled or attractive to children face an immediate stop-sale order.

The agency rule that carries out the law, Rule 5K-4.034 of the Florida Administrative Code, adds two requirements:

  • A permit. Every establishment distributing hemp food products needs a Hemp Food Establishment permit. It costs $650 a year.
  • Age checks on delivery. A product may not be mailed, shipped or delivered until the seller confirms the buyer is 21 or older.

Federal vs. State Rules

Two layers of law apply at once. Florida's rules decide who may sell and how. Federal law decides whether the product counts as “hemp” at all. Since 2018, a drink derived from hemp with no more than 0.3% delta-9 THC by dry weight has been legal hemp under federal law. That standard is what lets these drinks sit on store shelves and ship across state lines outside the marijuana system.

What Florida Tried to Change, 2024–2026

Florida's no-cap market has survived several attempts at restriction:

  • 2024: The Legislature passed SB 1698, which would have capped THC in hemp products. The Governor vetoed it.
  • 2025: SB 438, another hemp overhaul, died in the House.
  • 2026: Several bills aimed at THC drinks died when the session ended on March 13, 2026:
    • SB 1678 would have limited THC drinks to alcohol-licensed sellers.
    • HB 801 would have created a special beverage license.
    • HB 1409 and its Senate companion would have set open-container and under-21 rules.

None became law. Each new session brings new proposals, which is why this guide shows the date it was last checked.

What's Changing? The Future of THC Drinks in Florida

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. The hemp-derived delta-9 THC in the drinks we carry is a compound the plant produces, so December 11 is the date that applies to them.
