Understanding New Hampshire's Hemp Law

RSA 439-A:4 reads: "Nothing in this chapter shall be construed to authorize the sale of products that are derived from hemp which contain natural or synthetic tetrahydrocannabinol (THC) greater than 0.3 percent on a dry weight basis, … including delta-8 THC, delta-9 THC, or any other THC isomer variant." It has been in force since October 7, 2023. New Hampshire's drug law says marijuana "shall not include hemp grown, processed, marketed, or sold under RSA 439-A" (RSA 318-B:2-c).

The law does not say how a dry-weight test applies to a liquid, and we found no state guidance on it.

What SB 624 Changes on January 1, 2027

SB 624 became Chapter 275 of the 2026 laws, signed July 2, 2026. From January 1, 2027:

  • Total THC. Hemp is defined by "total tetrahydrocannabinols concentration (including tetrahydrocannabinolic acid) of not more than 0.3 percent on a dry weight basis."
  • A prohibition. RSA 439-A:4 adds THCA and a new sentence for products over the limit: "Such products are prohibited."
  • Age 21. New RSA 179:5, III bars any licensee, salesperson "nor any other person" from selling or giving away a hemp product with THC "in any amount" to anyone under 21.
  • Liquor licensees. All licensees must comply with RSA 439-A:4 (RSA 179:50, V).

The January 1 date is fixed in state law and does not refer to the federal change.

The 0.4mg Cap That Didn't Pass

The Senate's March 2026 version of SB 624 excluded "products that contain more than 0.4 mg total THC per container" from hemp and barred under-21 possession. The House rewrote the bill, passing its version 189-165 on May 14, 2026, and the Senate agreed on May 21. The enacted law has neither the 0.4mg cap nor a possession offense (bill docket).

A separate 2026 bill, SB 485, would have created a Liquor Commission licensing system and a wholesale tax for hemp products. It was sent to interim study on March 12, 2026.

What's Changing? The Future of THC Drinks in New Hampshire

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed.
