Maine treats hemp food and drink as hemp, not cannabis, as long as the finished product has no more than 0.3% delta-9 THC. A 2025 law added a category called "potentially intoxicating hemp products," which covers THC drinks, and made them 21+.

Maine has not capped milligrams per can, and bills that would have moved intoxicating hemp into the adult-use cannabis system were withdrawn. This guide covers what Maine law says, who may sell, where to buy, how to choose a strength, and what the federal change means for Maine. Every legal claim links to its primary source.

Key Takeaways

  • Legal for adults 21+. Maine bans selling potentially intoxicating hemp products, beverages included, to anyone under 21 (7 M.R.S. 2231(12)).
  • In force since June 24, 2025, under Public Law 2025, chapter 416 (LD 1920).
  • No milligram cap. The limit is 0.3% delta-9 THC in the finished product.
  • Sellers need a Maine license. Anyone who makes, sells or serves ingestible hemp products must hold a Maine food or liquor license.
  • Hemp food can't be banned just for containing hemp (22 M.R.S. 2158-A).
  • Federal change on December 11, 2026. Maine's definition of hemp follows federal law, so the new 0.4mg-per-container federal limit is likely to carry into Maine.
  • Don't drive after drinking one. Maine's OUI law covers drugs as well as alcohol.

Yes, for adults 21 and over. A hemp-derived delta-9 THC drink is legal in Maine if the finished product meets the state's hemp definition and is sold by a licensed business.

Understanding Maine's Hemp Law

Maine's hemp statute, 7 M.R.S. 2231, defines hemp to include "food, food additives and food products derived from hemp, which in their final forms contain a delta-9-tetrahydrocannabinol concentration of not more than 0.3% or as otherwise defined in federal law." Hemp is excluded from Maine's medical and adult-use cannabis laws (28-B M.R.S. 102-A).

The 2025 law created a category of "potentially intoxicating hemp products": ingestible products, beverages included, that are not both under 0.3% intoxicating cannabinoids and above a 10-to-1 ratio of non-intoxicating to intoxicating cannabinoids. The list of intoxicating cannabinoids covers delta-9, delta-8 and delta-10 THC, HHC, THC-O and synthetic THC. The list sets which products are 21+; it is not a ban.

The 21+ Rule

Section 2231(12) says: "A potentially intoxicating hemp product may not be sold to a person who has not attained 21 years of age." It came from LD 1920, an emergency bill that became law without the Governor's signature on June 24, 2025, as Public Law 2025, chapter 416, effective immediately.

What Maine Requires of Sellers and Products

  • A license. Anyone who makes, sells, offers for sale or serves ingestible hemp products must hold a Maine food or liquor license (7 M.R.S. 2231(4)). Food licenses are issued by the Department of Agriculture, Conservation and Forestry (22 M.R.S. 2167).
  • Packaging. Intoxicating hemp products need child-resistant, tamper-evident packaging, but beverages, salves and topicals are exempt. No hemp product may copy another company's trademarked packaging (7 M.R.S. 2231(13)).
  • No health claims. Sellers may not claim hemp food diagnoses, treats, cures or prevents disease (22 M.R.S. 2158-A). The same section says hemp food can't be banned just because it contains hemp.

What Maine Tried to Change, 2025–2026

  • LD 1983 would have moved intoxicating hemp products under the adult-use cannabis laws. It was withdrawn on January 13, 2026.
  • LD 548 (2025), "An Act Regarding Intoxicating Hemp Products," was also withdrawn.
  • LD 1942, on taxing these products, died on adjournment on April 29, 2026.

The Legislature's 2026 session digest lists no new hemp law.

Onset and Duration

THC drinks usually take effect in about 15 to 20 minutes, though it varies with your body, what you've eaten, and the drink. Effects typically last a few hours. Wait a full hour before opening a second one. Most bad experiences come from stacking cans before the first has fully kicked in. For more detail, read how long THC drinks take to kick in and how much to drink.

What's Changing? The Future of THC Drinks in Maine

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. Read our full explainer: what December 11 means for THC drinks.

Industry Response

Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed. December 11 is also the date the stopgap funding expires, so the next federal funding bill is the one to watch.

Why the Federal Change Reaches Maine

Maine's hemp definition covers products at or under 0.3% delta-9 THC "or as otherwise defined in federal law." The Department of Agriculture's hemp program said in its FY2025 report that the federal change "effectively outlawed hemp tetrahydrocannabinol (THC) beverages."

What It Means for Maine Buyers

  • Until December 11: nothing changes. Maine law and current federal law both allow the drinks covered in this guide for adults 21+.
  • After December 11: unless Congress acts, hemp THC drinks over 0.4mg per container lose federal hemp status in every state, Maine included. If you have favorites, stock up while the full lineup is here, and check how to store THC drinks so they keep.

THC Seltzers vs. Traditional Edibles: Key Differences

Hemp gummies are easier to find than drinks in many Maine shops. Many people who try both choose drinks for a few practical reasons.

Factor THC drinks Gummies and edibles
Typical onset About 15–20 minutes, though it varies Often 30 minutes to 2 hours
Dose control Easy to sip part of a can and stop Sold as fixed pieces; you cut them to adjust
Social fit Replaces the drink in your hand at a party or cookout Nothing to hold or sip
Calories Many seltzers run low; see our low-calorie picks Usually sugar-based

Absorption and Practical Considerations

Drinks often take effect sooner because they reach your stomach as a liquid, and many brands use water-soluble emulsions. Edibles have to be digested first. The faster onset has a downside: a second can tastes just like the first, so it's easy to drink one before the first has peaked. Pace yourself the way you would with cocktails. Read the full comparison: THC drinks vs. edibles.

THC Spirits and Mocktails: A Growing Category

Not every THC drink comes in a can. Zero-proof THC spirits are designed to replace the vodka, gin or tequila in a recipe you already make. You keep the drink and leave out the alcohol.

  • Twofold makes six low-dose spirits, from vodka to spiced rum.
  • Pamos sells its Signature (5mg) and Reserve (10mg) spirits in 750mL bottles and 50mL minis.
  • Reframe and the FLORA 10mg Spirit are made for mixing.

Driving and Drinking in Public

Maine makes it a crime to drive "under the influence of intoxicants" (29-A M.R.S. 2411), and intoxicants include "a drug other than alcohol" (29-A M.R.S. 2401). There is no THC number, so impairment is enough. Don't drive after drinking one.

Maine's limits on using cannabis in public apply to "cannabis," which excludes hemp. We found no state rule specific to drinking hemp THC beverages in public; local ordinances and venue rules still apply.

How to Check a Can Before You Drink It

Maine does not require a lab-report QR code on hemp drinks, so it is worth checking any can yourself. Before you open one from any seller:

  1. Find the QR code and scan it. It should open the certificate of analysis for that batch.
  2. Match the batch number on the can to the batch number on the COA.
  3. Compare the potency. The THC result on the COA should be close to the milligrams printed on the label.
  4. Check the expiration date, especially for cans that have sat on a warm shelf.

Industry testing has found that many THC drinks don't match their labels. Read how to read a COA for what to look for.

Why Trust This Guide

HempBeverages.com is an online retailer that ships THC drinks to Maine, so we have a commercial interest in this topic. We address that by sourcing every legal claim. The statements in this guide link to the Maine Revised Statutes, the Legislature's bill records and the federal public laws. We re-check them on the date shown at the top of the page. Our standards are on the editorial standards page. To compare Maine with other states, see where THC drinks are legal by state.

Final Verdict

Maine is an easy state to buy THC drinks in:

  • You must be 21 or older.
  • There is no state milligram cap.
  • Sellers need a Maine food or liquor license.
  • Bills to move these drinks into cannabis stores were withdrawn.

The real deadline is federal: December 11, 2026, when nearly every THC drink loses its hemp status unless Congress acts, and Maine's definition follows federal law. Until then, choose a strength that suits you, start lower than you think you need, and wait a full hour before a second drink.

Frequently Asked Questions

Are THC drinks legal in Maine?

Yes, for adults 21 and over. Maine law treats hemp food and drink products as hemp if the finished product has no more than 0.3% delta-9 THC (7 M.R.S. 2231), and hemp food can't be banned just because it contains hemp (22 M.R.S. 2158-A).

How old do you have to be to buy THC drinks in Maine?

21. Since June 24, 2025, Maine law has barred selling potentially intoxicating hemp products, beverages included, to anyone under 21 (7 M.R.S. 2231(12), Public Law 2025, chapter 416).

Is there a THC limit for drinks in Maine?

Maine sets no per-serving or per-container milligram cap. The limit is 0.3% delta-9 THC in the finished product. From December 11, 2026, a federal limit of 0.4mg of total THC per container applies nationwide.

Do THC drinks need child-resistant packaging in Maine?

No. The child-resistant, tamper-evident rule covers intoxicating hemp products other than beverages, salves and topicals. All hemp products must avoid packaging that copies another trademarked product.

Who can sell THC drinks in Maine?

Anyone who makes, sells or serves ingestible hemp products must hold a Maine food license or a liquor license (7 M.R.S. 2231(4)).

Will THC drinks be illegal in Maine after December 11, 2026?

Under federal law, hemp THC drinks with more than 0.4mg of total THC per container stop qualifying as hemp on December 11, 2026, unless Congress changes the law first. Maine's hemp definition follows federal law. This is general information, not legal advice.

Can I drive after drinking a THC drink in Maine?

Don't. Maine's OUI law makes it a crime to drive under the influence of intoxicants, which include drugs other than alcohol. There is no THC number, so being impaired is enough.

Do THC drinks show up on a drug test?

They can. Hemp-derived delta-9 THC is the same compound standard drug tests screen for, and a legal hemp source does not change the result. If you are tested for work, read do THC drinks show up on a drug test before you drink one.

Must be 21+. This guide is for informational purposes only and does not constitute legal advice. Hemp and THC laws change often and vary by state; this page reflects Maine and federal law as verified on October 4, 2026. Check current rules with official sources such as the Maine Legislature.
