Alabama moved hemp products under its alcohol regulator with Act 2025-451 (HB 445). The law created Title 28, Chapter 12 of the Alabama Code, took effect July 1, 2025, and required ABC Board licensing from January 1, 2026 (ABC Board). It sets 21 as the minimum age, caps drinks at 10mg of THC per serving, and bans smokable hemp.

The law also closes the door on online sales. Section 28-12-60 says: "Online sales, direct delivery, drive-through sales, and direct shipments of consumable hemp products within or into this state are strictly prohibited." This guide covers the limits, where to buy, penalties and the federal change on December 11, 2026. Every legal claim links to its primary source.

Key Takeaways

  • 10mg per can. A beverage serving may not exceed 12 fluid ounces or 10mg of total THC, with one serving per container (ABC Rule 20-X-32-.04).
  • Four cans per carton at most.
  • 21+. Sales to anyone under 21 are prohibited.
  • ABC-licensed retailers only. Specialty retailers, pharmacies and retail food stores may get licenses; food stores must keep hemp drinks behind glass.

Yes, for adults 21+, in person, from an ABC-licensed retailer, within the state's limits. Act 2025-451 sets the rules, and the ABC Board enforces them.

Beverage Limits

The act caps beverages and edibles at 10mg of total THC per serving and limits a beverage carton to four containers of 12 ounces. The ABC Board's Rule 20-X-32-.04 (effective December 15, 2025) adds that "a beverage serving size shall not exceed 12 fluid ounces or 10 milligrams of total THC," with no more than one serving per container. Packaging must be child-resistant and may not appeal to children.

Who May Sell

The ABC Board issues three license types: specialty retailer, pharmacy and retail food store. Food stores may sell hemp drinks but must keep them behind glass or clear plastic, and licensees must post a $25,000 surety bond (ABC Board).

No Online Sales, No Shipping

Section 28-12-60(a) of the act states: "Online sales, direct delivery, drive-through sales, and direct shipments of consumable hemp products within or into this state are strictly prohibited." A first violation is a Class A misdemeanor, and later violations are Class C felonies (Act 2025-451).

Penalties for Licensees

Sales to minors bring a 90-day suspension and $5,000 fine for a first offense, rising to revocation and a $20,000 fine.

Buying Online

Alabama law strictly prohibits online sales, direct delivery and direct shipments of consumable hemp products into the state, so ordering THC drinks online isn't a legal option. Check our where we ship page for our current status before you order.

Understanding Potency

Alabama caps drinks at 10mg per can, one serving per container. The number on a can is usually the THC in the whole container unless the label says otherwise. Drink half a 10mg can and you've had 5mg.

THC per serving Who it suits
Under 1mg Barely perceptible for most adults; the range of the new federal and some state limits
2–3mg First-timers, or a drink to sip with dinner
5mg A noticeable but mild effect; the most common starting dose
10mg Regular THC drinkers
20mg and up Experienced drinkers with a known tolerance only

Onset and Duration

THC drinks usually take effect in about 15 to 20 minutes, though it varies with your body, what you've eaten, and the drink. Effects typically last a few hours. Wait a full hour before having a second. For more detail, read how long THC drinks take to kick in and how much to drink.

What's Changing? The Future of THC Drinks in Alabama

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. Read our full explainer: what December 11 means for THC drinks.

Industry Response

Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed. December 11 is also the date the stopgap funding expires, so the next federal funding bill is the one to watch.

What It Means for Alabama

  • Today: 10mg drinks remain legal at ABC-licensed retailers.
  • December 11, 2026: unless Congress acts, hemp THC drinks over 0.4mg per container lose federal hemp status in every state, Alabama included.

THC Drinks vs. Edibles: Key Differences

Factor THC drinks Gummies and edibles
Typical onset About 15–20 minutes, though it varies Often 30 minutes to 2 hours
Dose control Easy to sip part of a can and stop Sold as fixed pieces; you cut them to adjust
Social fit Replaces the drink in your hand at a party or cookout Nothing to hold or sip

Drinks often take effect sooner because many brands use water-soluble emulsions. The downside: a second can tastes just like the first, so it's easy to drink one before the first has peaked. Read the full comparison: THC drinks vs. edibles.

Driving After a THC Drink

Alabama bars driving under the influence of any substance that impairs your mental or physical faculties to the point that you can't drive safely (Ala. Code §32-5A-191(a)(5)). If a drink affects you, don't drive.

How to Check a Can Before You Drink It

Alabama requires child-resistant, labeled hemp products. Before you open any can:

  1. Find the QR code and scan it. It should open the certificate of analysis for that batch.
  2. Match the batch number on the can to the batch number on the COA.
  3. Compare the potency. The THC result on the COA should be close to the milligrams printed on the label, and within Alabama's limit.
  4. Check the expiration date, especially for cans that have sat on a warm shelf.

Industry testing has found that many THC drinks don't match their labels. Read how to read a COA for what to look for.
