Louisiana rewrote its hemp rules with Act 752 of 2024, effective January 1, 2025. Under La. R.S. 3:1483, "a single serving of a consumable hemp beverage shall not exceed five milligrams and shall not be less than twelve ounces," each serving must be in its own container, and a package may hold no more than four. The Louisiana Department of Health (LDH) approves products and adopted a final rule in January 2026 (LDH rule).

Retail permits come from the Office of Alcohol and Tobacco Control (ATC). Out-of-state online sellers can qualify, but each website counts as its own place of business and needs its own permit (La. R.S. 3:1484). This guide covers the limits, who may sell, and the federal change on December 11, 2026. Every legal claim links to its primary source.

Key Takeaways

  • 5mg per serving. One serving per container, at least 12 ounces, no more than four containers per package (R.S. 3:1483).
  • 21+ with ID. Retailers must check a photo or digital ID before the sale.
  • ATC permit required. Up to $175 a year per place of business (R.S. 3:1484).
  • Online sellers too. "Each individually registered domain name" counts as a place of business, and the site must name the Louisiana-permitted wholesaler.
  • Not in bars, restaurants or gas stations. Class A alcohol permit holders can't get hemp permits (with narrow exceptions), and gas stations can't sell.
  • No hemp in alcohol. Alcoholic beverages containing hemp are banned.
  • Federal change on December 11, 2026. 0.4mg total THC per container becomes the federal hemp limit.

Yes, for adults 21+, within the state's limits and from a permitted seller. La. R.S. 3:1481 to 1485, as amended by Act 752 of 2024, set the rules.

Beverage Limits

R.S. 3:1483 caps a hemp beverage serving at 5mg and sets a 12-ounce minimum per serving. Each serving must be in its own tamper-evident container, and a package may hold no more than four. LDH's final rule, effective January 20, 2026, repeats those limits and requires a drug-screening warning on labels (LDH). Products must be approved by LDH.

Who May Sell

Retailers need an ATC permit for each place of business, at up to $175 a year. Remote retailers can qualify if they meet the same requirements, but "each individually registered domain name" counts as a separate place of business, and the website must name the Louisiana-permitted wholesaler the products came from (R.S. 3:1484). Holders of Class A alcohol permits (bars and restaurants) can't get hemp permits, except businesses that held both before June 17, 2024, and gas stations can't sell these products.

Penalties

Violations can bring fines of up to $300 for a first offense, up to $1,000 for a second, and $500 to $3,000 for a third within two years (R.S. 3:1484).

2026 Bill

HB 539, which would have allowed sales at bars and restaurants, was withdrawn on May 11, 2026.

Where to Buy THC Drinks in Louisiana

Louisiana retailers with an ATC hemp permit, such as dedicated shops and some grocery and convenience stores (but not gas stations), can sell 5mg hemp drinks. Check that the can is at least 12 ounces and no more than 5mg.

Buying Online

Louisiana allows online sales only by sellers holding an ATC permit for that specific website, who sell LDH-approved products and name their Louisiana-permitted wholesaler. Look for the seller's Louisiana permit and check that every can is 5mg or less. Check our where we ship page for our current status before you order.

Understanding Potency

Louisiana caps drinks at 5mg per can, a mild dose for most adults. The number on a can is usually the THC in the whole container unless the label says otherwise. Drink half a 10mg can and you've had 5mg.

THC per serving Who it suits
Under 1mg Barely perceptible for most adults; the range of the new federal and some state limits
2–3mg First-timers, or a drink to sip with dinner
5mg A noticeable but mild effect; the most common starting dose
10mg Regular THC drinkers
20mg and up Experienced drinkers with a known tolerance only

Onset and Duration

THC drinks usually take effect in about 15 to 20 minutes, though it varies with your body, what you've eaten, and the drink. Effects typically last a few hours. Wait a full hour before having a second. For more detail, read how long THC drinks take to kick in and how much to drink.

What's Changing? The Future of THC Drinks in Louisiana

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. Read our full explainer: what December 11 means for THC drinks.

Industry Response

Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed. December 11 is also the date the stopgap funding expires, so the next federal funding bill is the one to watch.

What It Means for Louisiana

  • Today: 5mg drinks remain legal from permitted sellers.
  • December 11, 2026: unless Congress acts, hemp THC drinks over 0.4mg per container lose federal hemp status in every state. A 5mg Louisiana drink would exceed the federal limit.

THC Drinks vs. Edibles: Key Differences

Factor THC drinks Gummies and edibles
Typical onset About 15–20 minutes, though it varies Often 30 minutes to 2 hours
Dose control Easy to sip part of a can and stop Sold as fixed pieces; you cut them to adjust
Social fit Replaces the drink in your hand at a party or cookout Nothing to hold or sip

Drinks often take effect sooner because many brands use water-soluble emulsions. The downside: a second can tastes just like the first, so it's easy to drink one before the first has peaked. Read the full comparison: THC drinks vs. edibles.

Driving After a THC Drink

Louisiana's DWI law covers driving while impaired by any drug (La. R.S. 14:98). If a drink affects you, don't drive.

How to Check a Can Before You Drink It

Louisiana requires LDH-approved, labeled hemp products with a drug-screening warning. Before you open any can:

  1. Find the QR code and scan it. It should open the certificate of analysis for that batch.
  2. Match the batch number on the can to the batch number on the COA.
  3. Compare the potency. The THC result on the COA should be close to the milligrams printed on the label, and within Louisiana's limit.
  4. Check the expiration date, especially for cans that have sat on a warm shelf.

Industry testing has found that many THC drinks don't match their labels. Read how to read a COA for what to look for.
