Kentucky moved hemp THC drinks into its alcohol system in 2025. SB 202, signed March 25, 2025 with an emergency clause, defines a "cannabis-infused beverage" and gives the Department of Alcoholic Beverage Control (ABC) sole authority over its distribution and retail sale (Acts 2025, ch. 82). Drinks may contain no more than 5mg of intoxicating cannabinoids per 12-ounce serving.

Retail sale is limited to package liquor stores in wet territory that hold a cannabis-beverage retail license. Direct shipping to consumers needs an ABC direct shipper license, which only manufacturers and licensed suppliers can get, for their own brands. This guide covers the limits, who may sell and ship, and the federal change on December 11, 2026. Every legal claim links to its primary source.

Key Takeaways

  • 5mg per 12oz. Drinks may contain no more than 5mg of intoxicating cannabinoids per 12-ounce serving (KRS 241.010).
  • 21+. "A person under twenty-one (21) years of age shall not purchase or consume" these drinks.
  • Liquor stores in wet areas. Retail sale is limited to licensed package stores in wet territory.
  • Direct shipping: manufacturers and suppliers only. The $100-a-year direct shipper license is limited to manufacturers and licensed suppliers, for their own brands.

Yes, for adults 21+, as cannabis-infused beverages sold through Kentucky's alcohol system. SB 202 (Acts 2025, ch. 82) sets the rules.

Limits

A cannabis-infused beverage may contain no more than 5mg of intoxicating cannabinoids per 12-ounce serving, and the cannabinoids must come from a USDA-sanctioned hemp program (KRS 241.010). The law sets no separate per-container cap.

Who May Sell

ABC "solely" regulates distribution and retail sale, while the state health agency licenses manufacturers. In stores, only package liquor retailers in wet territory that hold both a quota retail package license and a cannabis-beverage retail license may sell, by the package (Acts 2025, ch. 82). The retail license costs $500 a year.

Direct Shipping

A direct shipper license costs $100 a year and is open only to manufacturers (in Kentucky or another state), cannabis-beverage manufacturers licensed by the state, and licensed alcohol suppliers, who may ship only their own brands. Shipments are limited to 10 cases per customer per month, must be labeled for adult-signature delivery, must go by common carrier, and may not go into dry areas (KRS 243.027, 243.028). Retailers are not eligible.

2026 Bills

  • SB 223 would have allowed bars and restaurants to sell these drinks. It passed the Senate on March 20, 2026 and went no further.
  • HB 9, on taxes and fees, passed the House but was not enacted.

Understanding Potency

Kentucky caps drinks at 5mg per 12-ounce serving. The number on a can is usually the THC in the whole container unless the label says otherwise. Drink half a 10mg can and you've had 5mg.

THC per serving Who it suits
Under 1mg Barely perceptible for most adults; the range of the new federal and some state limits
2–3mg First-timers, or a drink to sip with dinner
5mg A noticeable but mild effect; the most common starting dose
10mg Regular THC drinkers
20mg and up Experienced drinkers with a known tolerance only

Onset and Duration

THC drinks usually take effect in about 15 to 20 minutes, though it varies with your body, what you've eaten, and the drink. Effects typically last a few hours. Wait a full hour before having a second. For more detail, read how long THC drinks take to kick in and how much to drink.

What's Changing? The Future of THC Drinks in Kentucky

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. Read our full explainer: what December 11 means for THC drinks.

Industry Response

Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed. December 11 is also the date the stopgap funding expires, so the next federal funding bill is the one to watch.

What It Means for Kentucky

  • Today: 5mg-per-12oz drinks remain legal through the liquor system.
  • December 11, 2026: unless Congress acts, hemp THC drinks over 0.4mg per container lose federal hemp status in every state. A 5mg Kentucky drink would exceed the federal limit.

THC Drinks vs. Edibles: Key Differences

Factor THC drinks Gummies and edibles
Typical onset About 15–20 minutes, though it varies Often 30 minutes to 2 hours
Dose control Easy to sip part of a can and stop Sold as fixed pieces; you cut them to adjust
Social fit Replaces the drink in your hand at a party or cookout Nothing to hold or sip

Drinks often take effect sooner because many brands use water-soluble emulsions. The downside: a second can tastes just like the first, so it's easy to drink one before the first has peaked. Read the full comparison: THC drinks vs. edibles.

Driving After a THC Drink

Kentucky makes it illegal to drive under the influence of any substance that impairs your driving ability (KRS 189A.010). If a drink affects you, don't drive.

How to Check a Can Before You Drink It

Kentucky regulates these drinks through the liquor system, with state-licensed manufacturers. Before you open any can:

  1. Find the QR code and scan it. It should open the certificate of analysis for that batch.
  2. Match the batch number on the can to the batch number on the COA.
  3. Compare the potency. The THC result on the COA should be close to the milligrams printed on the label, and within Kentucky's limit.
  4. Check the expiration date, especially for cans that have sat on a warm shelf.

Industry testing has found that many THC drinks don't match their labels. Read how to read a COA for what to look for.
