Iowa regulates "consumable hemp products" under Iowa Code chapter 204. A product may contain no more than "four milligrams per serving and ten milligrams per container," and Iowa HHS rules require liquid products to be "packaged in a container that holds a minimum of 12 fluid ounces" (641 IAC 156.1). Products made with synthetic cannabinoids are banned.

Iowa's rules also reach online sellers. A retailer "includes an establishment selling consumable hemp products online," and every retailer must register at least 30 days before "selling any consumable hemp product in Iowa or to purchasers located in Iowa" (641 IAC 156.2). This guide covers the limits, who may sell, and the federal change on December 11, 2026. Every legal claim links to its primary source.

Key Takeaways

  • 4mg per serving, 10mg per container. The statutory cap for consumable hemp products (Iowa Code 204.2).
  • 12 ounces minimum. HHS allows 4mg in a 12oz drink, 5.33mg in 16oz, 8mg in 24oz and 10mg in 30oz (HHS guidance).
  • 21+ with photo ID. Selling to anyone under 21 is a misdemeanor.
  • Registration. Every seller, online sellers included, must register with Iowa HHS and sell only products on its Master Product List.
  • No hemp in alcohol. Iowa alcohol licensees may not add hemp to alcoholic drinks.
  • Penalties: civil fines of up to $10,000 a day for selling without registration.
  • Strict driving law. Driving with any amount of a controlled substance in your blood or urine is an offense.

Yes, for adults 21+, within Iowa's limits and from a registered seller.

The Limits

Iowa Code 204.2 caps consumable hemp products at the lesser of 0.3% THC or 4mg per serving and 10mg per container. HHS rules set a 12-ounce minimum container for drinks, and HHS guidance scales the cap with volume: 4mg for 12oz, 5.33mg for 16oz, 6.66mg for 20oz, 8mg for 24oz and 10mg for 30oz. HHS says it "does not have authority to provide flexibility" on those limits (HHS), so an 8-ounce drink fails at any dose.

Who May Sell

Every retailer must register with Iowa HHS at least 30 days before selling, renew every year, and sell only products on the state's Master Product List. Online sellers count as retailers and must post their registration on the website before payment (641 IAC 156.2). Products made in other states must come from states with "substantially similar testing requirements."

Penalties

Selling without registration can bring civil fines of up to $10,000 a day and is a serious misdemeanor. Other violations carry fines of $500 to $2,500 a day, and noncompliant products can be embargoed (Iowa Code 204.12, 204.14B, 204.14C).

2026 Session

HSB 753, a broader hemp bill, cleared a House committee in February 2026 but was not enacted. No 2026 law changed chapter 204.

Understanding Potency

Iowa caps drinks at 4mg per 12-ounce serving and 10mg per container. The number on a can is usually the THC in the whole container unless the label says otherwise. Drink half a 10mg can and you've had 5mg.

THC per serving Who it suits
Under 1mg Barely perceptible for most adults; the range of the new federal and some state limits
2–3mg First-timers, or a drink to sip with dinner
5mg A noticeable but mild effect; the most common starting dose
10mg Regular THC drinkers
20mg and up Experienced drinkers with a known tolerance only

Onset and Duration

THC drinks usually take effect in about 15 to 20 minutes, though it varies with your body, what you've eaten, and the drink. Effects typically last a few hours. Wait a full hour before having a second. For more detail, read how long THC drinks take to kick in and how much to drink.

What's Changing? The Future of THC Drinks in Iowa

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. Read our full explainer: what December 11 means for THC drinks.

Industry Response

Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed. December 11 is also the date the stopgap funding expires, so the next federal funding bill is the one to watch.

What It Means for Iowa

  • Today: drinks within Iowa's 4mg and 10mg limits remain legal from registered sellers.
  • December 11, 2026: unless Congress acts, hemp THC drinks over 0.4mg per container lose federal hemp status in every state, Iowa included. Iowa HHS has not published guidance on the change.

THC Drinks vs. Edibles: Key Differences

Factor THC drinks Gummies and edibles
Typical onset About 15–20 minutes, though it varies Often 30 minutes to 2 hours
Dose control Easy to sip part of a can and stop Sold as fixed pieces; you cut them to adjust
Social fit Replaces the drink in your hand at a party or cookout Nothing to hold or sip

Drinks often take effect sooner because many brands use water-soluble emulsions. The downside: a second can tastes just like the first, so it's easy to drink one before the first has peaked. Read the full comparison: THC drinks vs. edibles.

Driving After a THC Drink

Iowa makes it an offense to drive "while any amount of a controlled substance is present in the person, as measured in the person's blood or urine" (Iowa Code 321J.2). Since 2025, an open container of a THC drink in a vehicle's passenger area is also an offense (Iowa Code 321.284). Compliant hemp is not a controlled substance under Iowa law, but no court has said how the "any amount" rule applies to it. Don't drive after a THC drink.

How to Check a Can Before You Drink It

Iowa requires approved, labeled products and posted lab reports. Before you open any can:

  1. Find the QR code and scan it. It should open the certificate of analysis for that batch.
  2. Match the batch number on the can to the batch number on the COA.
  3. Compare the potency. The THC result on the COA should be close to the milligrams printed on the label, and within Iowa's cap for that container size.
  4. Check the expiration date, especially for cans that have sat on a warm shelf.

Industry testing has found that many THC drinks don't match their labels. Read how to read a COA for what to look for.
