Public Act 104-0463 passed both houses on June 1, 2026 and was signed June 12, 2026 (bill status). Parts took effect that day. As amended, 505 ILCS 89/20:

  • bars selling to anyone under 21 a hemp product with more than "a per-container total of 0.4 milligrams" of THC, or any product with synthetic or non-natural cannabinoids
  • requires retailers to verify age by examining a valid government-issued photo ID, for any purchaser who appears under 30
  • requires labels to show the product name, net volume, full ingredients, milligrams of each cannabinoid per serving and per container (including total THC), servings per container, a batch or lot number, contact details and an expiration date
  • bans false claims, health claims and packaging that appeals to children, such as cartoons, toys, animals or children

The Attorney General can enforce those rules under the Consumer Fraud Act.

What Changes on November 12, 2026

Section 180 of the Act says: "The Industrial Hemp Act is repealed on November 12, 2026." Section 999 puts the new Illinois Hemp Act into effect the same day. From then:

  • "Hemp" excludes any final product with "more than a per-container total of 0.4 milligrams of total tetrahydrocannabinols."
  • Products that miss the hemp definition "are considered cannabis" under the Cannabis Regulation and Tax Act, and only businesses licensed under that Act may sell them.
  • Selling cannabis without a license carries a civil penalty of up to $10,000 per offense, with each day a separate violation.
  • Products at or under 0.4mg must be lab tested, carry a COA link, use child-resistant packaging and contain no alcohol.

On November 12, 2026, the new Illinois Hemp Act takes effect, and any drink with more than 0.4mg of total THC per container becomes cannabis under state law. The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103.
