THC Drinks in New York: The 1mg Rule, Who Can Sell, and What's Changing (2026)

Three cans of hemp-derived THC drinks, illustrating a guide to New York THC drink law

Only at very low doses. New York allows hemp THC drinks at no more than 1mg of THC per serving, one serving per container, and only from a seller holding an Office of Cannabis Management hemp retail license, online or in person. Most hemp THC drinks sold in other states are 5 to 10 times stronger. Here are the rules.

Buying THC drinks in New York: the short version
  • A hemp THC drink sold in New York may contain no more than 1mg of THC, in a single-serve container.
  • Every seller, in a store or online, needs an OCM cannabinoid hemp retail license.
  • Drinks over 0.5mg THC per serving are 21+.
  • Stronger THC drinks are sold only as licensed adult-use cannabis products at licensed dispensaries.

New York regulates hemp products through the Office of Cannabis Management (OCM) under 9 NYCRR Part 114. Those rules set some of the lowest limits in the country: 1mg of total THC per serving and 10mg per package, and beverages may hold only one serving per container. In practice, a legal New York hemp THC drink contains 1mg of THC or less.

That is why the 5mg and 10mg seltzers common in other states aren't legal hemp products in New York. Stronger THC drinks are available only through New York's licensed adult-use cannabis dispensaries. This guide covers the hemp rules, who may sell, what bills are pending, and the federal change on December 11, 2026. Every legal claim links to its primary source.

Key Takeaways

  • 1mg per serving, one serving per can. Hemp products taken by mouth may contain no more than 1mg total THC per serving and 10mg per package, and beverages may not hold more than one serving (9 NYCRR §114.8).
  • 21+ above 0.5mg. Products over 0.5mg THC per serving may be sold only to adults 21+ (§114.16(a)).
  • License required, online too. No one may sell cannabinoid hemp products to New York consumers without an OCM cannabinoid hemp retailer license (§114.3(a)).
  • No synthetic cannabinoids and no more than 0.3% delta-9 THC.
  • Penalties run up to $1,000, $5,000 and $10,000 for first, second and third violations (§114.17).
  • Bills to raise the limit are pending, including S8575 (5mg per container), but none has passed.
  • Federal change on December 11, 2026. 0.4mg total THC per container becomes the federal hemp limit.

Yes, but only at very low doses. A hemp THC drink sold in New York must meet OCM's Part 114 rules, and those rules effectively cap a drink at 1mg of THC.

The Part 114 Limits

Under 9 NYCRR §114.8, hemp products meant to be swallowed may contain no more than 1mg of total THC per serving and 10mg per package. Beverages may not contain more than a single serving per package, though several packages can be sold together. Products may not exceed 0.3% delta-9 THC and may not contain synthetic or isomerized cannabinoids. OCM's guidance for licensees explains the rules in plain language.

Who May Sell

Section 114.3(a) bars anyone from offering or selling cannabinoid hemp products to New York consumers without an OCM cannabinoid hemp retailer license. OCM says the license applies to businesses selling "online and in person," and lists the fee at $300 per retail location (OCM). Licensed retailers must verify that buyers of products over 0.5mg per serving are 21+ (§114.11(b), §114.16(a)). Adult-use dispensaries may sell hemp products only if they also hold the hemp retail license.

Pending Bills

  • S8575, the Hemp Beverage and Taxation Act, would allow 5mg per container for adults 21+. It has been in Senate committee since January 7, 2026.
  • S7130 would set a 15:1 CBD-to-THC ratio. It is in committee. Some news reports have described the ratio as current law; it is not.

Where to Buy THC Drinks in New York

Legal hemp THC drinks in New York come from OCM-licensed hemp retailers and contain 1mg or less per can. If you want a stronger THC drink, the legal option is an adult-use cannabis dispensary licensed by OCM. If a bodega sells a 10mg hemp seltzer, that product doesn't meet New York's hemp rules.

Buying Online

New York requires an OCM cannabinoid hemp retail license for online sales to New York consumers, and the 1mg-per-container limit applies to every product sold. Before you order online, confirm the seller's New York license and check that the drink is 1mg or less per can. Check our where we ship page for our current status before you order.

Understanding Potency

New York's hemp limit sits at the very bottom of the potency scale: 1mg per can. The number on a can is usually the THC in the whole container unless the label says otherwise. Drink half a 10mg can and you've had 5mg.

THC per serving Who it suits
Under 1mg Barely perceptible for most adults; the range of the new federal and some state limits
2–3mg First-timers, or a drink to sip with dinner
5mg A noticeable but mild effect; the most common starting dose
10mg Regular THC drinkers
20mg and up Experienced drinkers with a known tolerance only

Onset and Duration

THC drinks usually take effect in about 15 to 20 minutes, though it varies with your body, what you've eaten, and the drink. Effects typically last a few hours. Wait a full hour before having a second. For more detail, read how long THC drinks take to kick in and how much to drink.

What's Changing? The Future of THC Drinks in New York

The Federal Hemp Definition Change

In November 2025, Congress rewrote the federal definition of hemp in Section 781 of the agriculture funding law, Public Law 119-37. Under the new definition, a finished product with more than 0.4 milligrams of total THC per container is no longer hemp. A 5mg seltzer has 12.5 times that amount, and a 10mg can has 25 times.

The change was set to take effect November 12, 2026. On September 2, 2026, the President signed a stopgap funding bill, Public Law 119-103. Its Section 2019 moves most of the change to December 11, 2026. One part was not delayed: cannabinoids that the cannabis plant cannot produce naturally lose hemp status on November 12. Read our full explainer: what December 11 means for THC drinks.

Industry Response

Several bills in Congress would replace the ban with regulation. One is H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5mg per serving, sold through an alcohol-style distribution system. As of this update, none has passed. December 11 is also the date the stopgap funding expires, so the next federal funding bill is the one to watch.

What It Means for New York

  • Hemp drinks: New York's 1mg limit is already close to the new federal 0.4mg-per-container standard. After December 11, a 1mg hemp drink would exceed the federal limit.
  • Bills: S8575 would raise the hemp drink limit to 5mg per container. We will update this guide if it moves.
  • Cannabis drinks: licensed adult-use products are regulated separately under state cannabis law.

THC Drinks vs. Edibles: Key Differences

Factor THC drinks Gummies and edibles
Typical onset About 15–20 minutes, though it varies Often 30 minutes to 2 hours
Dose control Easy to sip part of a can and stop Sold as fixed pieces; you cut them to adjust
Social fit Replaces the drink in your hand at a party or cookout Nothing to hold or sip

Drinks often take effect sooner because many brands use water-soluble emulsions. The downside: a second can tastes just like the first, so it's easy to drink one before the first has peaked. Read the full comparison: THC drinks vs. edibles.

Driving After a THC Drink

New York has no per se THC limit. Driving while impaired by a drug is an offense under Vehicle and Traffic Law §1192(4) and (4-a). If a drink affects you, don't drive.

How to Check a Can Before You Drink It

New York requires lab testing and detailed labels on licensed hemp products. Before you open any can:

  1. Find the QR code and scan it. It should open the certificate of analysis for that batch.
  2. Match the batch number on the can to the batch number on the COA.
  3. Compare the potency. The THC result on the COA should be close to the milligrams printed on the label, and within New York's limit.
  4. Check the expiration date, especially for cans that have sat on a warm shelf.

Industry testing has found that many THC drinks don't match their labels. Read how to read a COA for what to look for.

What is the THC limit for hemp drinks in New York?

1mg of total THC per serving and 10mg per package, and beverages may contain only one serving. In practice, that means 1mg or less per can.

How old do you have to be to buy THC drinks in New York?

21 for hemp products over 0.5mg of THC per serving (9 NYCRR §114.16(a)), and 21 for adult-use cannabis.

Can THC drinks be shipped to New York?

Only by a seller holding an OCM cannabinoid hemp retail license, which OCM says covers online sales, and only products that meet the 1mg limit.

Those products don't meet New York's Part 114 limits for hemp. Licensed dispensaries sell stronger THC drinks as adult-use cannabis, which is a separate system.

Will THC drinks be illegal in New York after December 11, 2026?

Under federal law, hemp THC products with more than 0.4mg of total THC per container stop qualifying as hemp on December 11, 2026, unless Congress acts. That would affect New York's 1mg hemp drinks. This is general information, not legal advice.

Can I get a DWI from a THC drink in New York?

Yes. Vehicle and Traffic Law §1192(4) and (4-a) cover driving while impaired by a drug. There is no per se THC limit.

Do THC drinks show up on a drug test?
