December 11, 2026 is now the date hemp-derived THC drinks lose federal hemp status. A short-term government funding bill signed in early September moved the deadline back one month from November 12. It is a delay, not a repeal: the new 0.4 milligram per-container limit is unchanged, and it is still on track to take nearly every hemp THC drink off the market.
What changed in September
The hemp redefinition in Public Law 119-37 was set to take effect November 12, 2026. The funding bill (H.R. 6500) moved most of it, including the 0.4 milligram cap and the new total-THC standard, to December 11, the day that funding bill runs out (Brewers Association). One piece kept the original date: cannabinoids the plant cannot naturally produce lose hemp status on November 12 (Cannabusiness Law). We only carry hemp-derived Delta-9 drinks, so December 11 is the date that matters on our shelf.
What the extra month does and does not do
It buys time for Congress to replace the ban with regulation. Bills on the table include the Lawful Hemp Protection Act (H.R. 9830) and H.R. 10079, which would allow hemp THC beverages for adults 21+ at up to 5 mg of THC per serving through a three-tier system like alcohol. None has passed. If nothing changes, the arithmetic is the same as it was in August: a 5mg seltzer is 12.5 times the new limit and a 10mg can is 25 times it.
